29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about May 10, 2023, employees framing a new construction home at a height greater than six feet, were not protected from falls to the lower level. a) Two basement stair openings near the front of the residence were left unguarded. b) Four window openings were left unguarded. c) The rear exposure of the home was left unguarded. BMK Enterprises, LLC was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent Standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1307475 Citation Number 2, Item Number 1 and was affirmed as a final order on June 13, 2018, with respect to a workplace located at 3117 Mendota Ct., Oconomowoc, WI 53066. BMK Enterprises, LLC was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent Standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1258047 Citation Number 1, Item Number 1b and was affirmed as a final order on September 27, 2017, with respect to a workplace located at 1712 Moccasin Trail, Waukesha, WI 53189.
