29 CFR  1926.20(b)(1):The employer did not initiate and maintain such programs as may be necessary to comply with this part.  a.  Progressive Poured Walls, LLC located at worksite 32460 Lake Road, Avon Park, Ohio 44012.  On or about May 11, 2023,  employees were working in and/or around excavations without the benefit of accident prevention programs to identify and mitigate associated hazards. Employees operating in this condition were exposed to hazards common in this industry such as, but not limited to, crushed by and struck by.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:   a.  Progressive Poured Walls, LLC located at worksite 32460 Lake Road, Avon Park, Ohio 44012.  On or about May 11, 2023, The employer did not ensure an employee was protected from head injuries while working in an excavation below overhead hazards such as excavation equipment. The employee was exposed to potential impact injuries associated with falling equipment and/or debris.

29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a.  Progressive Poured Walls, LLC located at worksite 32460 Lake Road, Avon Park, Ohio 44012.  On or about May 10, 2023, the employer did not ensure a safe means of egress,  was provided to employee(s) performing work in a 15 feet deep trench. One employee was exposed to hazards associated with the inability to exit the trench quickly in case of an emergency.

29 CFR  1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.  a.  Progressive Poured Walls, LLC located at worksite 32460 Lake Road, Avon Park, Ohio 44012.  On or about May 11, 2023,  the employer failed to ensure a competent person assessed an 15 foot deep excavation prior to employees working in the opened excavation. An employee working in the excavation was not benefited with an inspection by a competent person to ensure structural integrity, appropriate soil classification and adequate protective systems prior to the start of work.  The employer did not maintain and effective plan to ensure adequate cave-in protection for employees that were to enter the excavation.

Progressive Poured Walls, LLC located at worksite 32460 Lake Road, Avon Park, Ohio 44012.  On or about May 11, 2023, the employer failed to ensure employees were protected from cave-in hazards while performing sewer line installation activities in an approximately 15 ft. deep trench.
