29 CFR  1926.1053(b)(9): The area around the top and bottom of ladders shall be kept clear:  On or about May 12, 2023, at a jobsite located at 1228 Ridgeview Drive, Appleton, WI, employees of Roof Damage Solutions, LLC were observed using an aluminum extension ladder to access the working surface of a residential home. Two plastic wrapped bundles of shingles had been placed at the base of the aluminum extension ladder and one plastic wrapped bundle of shingles had been placed at the roof edge ladder area which created a tripping and slipping hazard accessing and exiting the aluminum extension ladder.

29 CFR  1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, shall either be immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired:  On or about May 12, 2023, at a jobsite located at 1228 Ridgeview Drive, Appleton, WI, employees of Roof Damage Solutions, LLC were observed using a damaged aluminum extension ladder to access the roof area of a residential home. The aluminum extension ladder was missing one of the two rung locks.

29 CFR  1926.501(b)(13):" Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems:  On or about May 12, 2023, at a jobsite located at 1228 Ridgeview Drive, Appleton, WI, employees of Roof Damage Solutions, LLC were conducting roofing work on a residential home without the use of fall protection and were exposed to fall hazards 8.75 feet and greater.  Roof Damage Solutions, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 1576932, citation number 1, item number1/a, and was affirmed as a final order on March 15, 2022, with respect to a workplace located at 108 West 3rd Avenue, Gulf Shores, Alabama.  Roof Damage Solutions was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1628174, citation number 2, item number 1 and was affirmed as a final order on November 30, 2022, with respect to a workplace located at 4717 N Hastings Court, Appleton, Wisconsin.  Roof Damage Solutions, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 1629169, citation number 2, item number 1 and was affirmed as a final order on April 12, 2023, with respect to a workplace located at 1360 West Brickstone Court, Appleton, Wisconsin.

Roof Damage Solutions, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1576932, citation number 1, item number 1/b and was affirmed as a final order on March 14, 2022, with respect to a workplace located at 108 W 3rd Avenue, Gulf Shores, Alabama. The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards.  On or about October 14, 2022, with respect to a worksite located at 1228 Ridgeview Drive, Appleton, WI, employees of Roof Damage Solutions, LLC were observed using a damaged 20 foot aluminum extension ladder to access the working surface of a residential home. Employees had not received training in the safe usage of ladders prior to being allowed to use the 20 foot aluminum extension ladder.  Roof Damage Solutions, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1060(a), which was contained in OSHA inspection number 1628174, citation number 1, item number 2 and was affirmed as a final order on April 12, 2023, with respect to a workplace located at 4717 N Hastings Court, Appleton, Wisconsin.
