29 CFR 1910.147(c)(4)(i): Procedures shall be developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section. Note: Exception: The employer need not document the required procedure for a particular machine or equipment, when all of the following elements exist: (1) The machine or equipment has no potential for stored or residual energy or reaccumulation of stored energy after shut down which could endanger employees; (2) the machine or equipment has a single energy source which can be readily identified and isolated; (3) the isolation and locking out of that energy source will completely deenergize and deactivate the machine or equipment; (4) the machine or equipment is isolated from that energy source and locked out during servicing or maintenance; (5) a single lockout device will achieve a locker-out condition; (6) the lockout device is under the exclusive control of the authorized employee performing the servicing or maintenance; (7) the servicing or maintenance does not create hazards for other employees; and (8) the employer, in utilizing this exception, has had no accidents involving the unexpected activation or reenergization of the machine or equipment during servicing or maintenance. a. On or about May 31, 2023 and at times prior, the employer did not develop a machine specific energy control procedure for employees to utilize when performing service and maintenance covered activities on the small Haas CNC machine such as, but not limited to, cleaning the machine, retrieving broken tooling and initial set up activities. b. On or about May 31, 2023 and at times prior, the employer did not develop a machine specific energy control procedure for employees to utilize when performing service and maintenance covered activities on the Haas VS-3 CNC machine such as, but not limited to, cleaning the machine, retrieving broken tooling and initial set up activities. c. On or about May 31, 2023 and at times prior, the employer did not develop a machine specific energy control procedure for employees to utilize when performing service and maintenance covered activities on the Vision Wide Tech Co. F-4000 CNC machine such as, but not limited to, cleaning the machine, retrieving broken tooling and initial set up activities. d. On or about May 31, 2023 and at times prior, the employer did not ensure that documented energy control procedures were utilized by employees performing service and maintenance covered activities on mechanical power press equipment such as, but not limited to, die adjustments, die changes, scrap removal and equipment inspections. This most recently occurred on May 31, 2023, on the Danly 1000 Ton Press, Press #4, while an employee performed die adjustments without the utilizing the documented procedure.

On or about May 31, 2023, the employer did not ensure that all employees implementing energy isolation and control steps on mechanical power presses, such as applying a lockout device, were trained on the applicable power press energy control procedures in order to understand hazardous energy sources associated with the equipment and the procedures necessary to ensure energy isolation and control was performed and verified.

29 CFR 1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in sequence as required by 29 CFR 1910.147(d)(1) through (d)(6): a. On or about May 31, 2023, employees were exposed to machine hazards associated with moving parts and pinch points during set-up, servicing and cleaning of the Vision Wide Tech Co. F-4000 CNC machine. The employer did not ensure that energy control application steps were implemented as the machine was not shut down or turned off to perform the servicing work [per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)(i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards. b. On or about May 31, 2023, employees were exposed to machine hazards associated with moving parts and pinch points during set-up, servicing and cleaning of the Haas VS-3 CNC machine. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc. a. On or about May 31, 2023, employees were exposed to flying metal material and the rotating chuck while operating the Cincinnati Bickford Tool radial arm drill press, No. 6E-861, due to a lack of machine guarding. b. On or about May 31, 2023, employees were exposed to flying metal material and the rotating chuck while operating the Atrump Machinery vertical milling machine, Model AONE-3EV, Serial 106083, due to a lack of machine guarding.

29 CFR 1910.217(b)(14):Brake system monitoring. When required by paragraph (c)(5) of this section, the brake monitor shall meet the following requirements: 29 CFR 1910.217(b)(14)(i): Be so constructed as to automatically prevent the activation of a successive stroke if the stopping time or braking distance deteriorates to a point where the safety distance being utilized does not meet the requirements set forth in paragraph (c)(3)(iii)(e) or (c)(3)(vii)(c) of this section. The brake monitor used with the Type B gate or movable barrier device shall be installed in a manner to detect slide top-stop overrun beyond the normal limit reasonably established by the employer. 29 CFR 1910.217(c)(3)(iii)(c): The device shall be constructed so that a failure within the system does not prevent the normal stopping action from being applied to the press when required, but does prevent the initiation of a successive stroke until the failure is corrected. The failure shall be indicated by the system. a. On or about May 13, 2023, employees were pressing a brake monitoring system reset button while operating a British Clearing 450 Ton Part-Revolution Power Press, Press #3, in order to override a fault condition detected by the press's brake monitor without evaluating the press and correcting the conditions which caused the fault, thereby exposing employees to crushed-by hazards.

The employer shall insure by adequate supervision that correct operating procedures are being followed. a. On or about May 13, 2021, the employer did not ensure that press operators and supervisors were effectively trained on mechanical power press operations including, but not limited to, press components and basic functions of brake monitoring systems, in order to understand safe operation of presses was maintained. Effective supervision of press operations was not maintained to ensure correct operating procedures were being followed by operators.
