OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-in and pinch-point hazards from riding and working from an area of a machine not meant for employees to ride from: a) Bay 2 Area of the building - On or prior to May 4, 2023, employees would work and rake from, and ride the frame of the Weckenmann Concrete Spreader (Cast Machine A, Serial No. P22154-B20-1 / 999999 (207736)07 / 2021), exposing employees to caught-in and pinch-point hazards. This area of the machine was not designed to have workers positioned in that location.
