29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a. Located at Homesite 5373 Shannon Square Drive, Canal Winchester, OH 43110: On or about May 15, 2023, employees working at a height of approximately 25 feet while shingling an under-construction residential roof were not protected from fall hazards by the use of a fall prevention or arrest system. Jose Rusbel Jara Juarez was previously cited under the name Jose Juarez for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1506125, citation number 1, item number 2/a and was affirmed as a final order on July 1, 2021, with respect to a workplace located at 4252 Town Square Drive in Canal Winchester, OH 43110.
