29 CFR 1910.1053(j)(1): The employer did not ensure that each employee was trained in accordance with the provisions of the hazard communication standard (HCS) and paragraph (j)(3) of this section: In the Big Y Express store at 202 West St. Pittsfield, MA: On May 17, 2023, and at times prior, the employer did not include respirable crystalline silica in the hazard communication program, post warning signs at all entrances, and provide employee information and training who were exposed to concrete dust containing between 3% and 8% respirable crystalline silica during a construction activity.
