29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). On or about May 17, 2023, at the new Splash carwash, employees were exposed to fall hazards when they used a model S-45 Genie aerial lift to gain access to the roof of the building without the use of a fall restraint or fall arrest system.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system: a) On or about May 17, 2023, at the new Splash carwash, employees were exposed to fall hazards in excess of 6-feet while installing a drip edge along the front (west) side of the building's roof without fall protection.
