On or about March 8, 2023, in the Dice Pack area, employees were required to service and maintain machines and equipment, specifically, the Armor Inox Metal Detector.  The employer did not conduct an annual or more frequent inspection of the energy control procedures to ensure that the procedures and requirements of the standard were being followed.

29 CFR  1910.147(c)(7)(i):  The employer did not provide adequate training to ensure that employees acquired the knowledge and skills required for the safe application, usage and removal of energy control devices.  a.  On or about March 8, 2023, in the Dice Pack Area, the employer did not provide effective training to affected and other employees to include all of the elements in (a) through (c), thereby exposing employees to the hazards associated with unexpected re-energization of equipment.  An employee was required to assemble guiderails during machine setup on an energized metal detector conveyor system and sustained lacerations to left hand when hand and arm was pulled into the equipment.

29 CFR 1910.147(c)(8):   Lockout or tagout was not performed only by the authorized employees who are performing the servicing or maintenance.  a.  On or about March 8, 2023, in the Dice Pack Area, the employer failed to ensure than an authorized employee was assigned the task of performing service and/or maintenance, specifically setting up guardrails on Armor Inox Metal Detector, and conducting an effective lockout of the machine.  A machine operator sustained lacerations to left hand fingers while assembling guardrails on each side of metal detector's conveyor belt, thereby exposing employees to the unexpected energization, start up or release of stored energy.

29 CFR 1910.147(d):  The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):  a.  On or about March 8, 2023, employees were exposed to caught-in and caught-by machine hazards when engaged in servicing and  maintenance activities, specifically setting up metal detector equipment, in the Dice Pack area.  The employer did not ensure that employees implemented energy control application steps during set-up activities, exposing them to laceration and amputation injuries on the Armor Inox metal detector's conveyor belt.  The machine  was not shut down or turned off prior to engaging in the servicing and maintenance activity.  As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147 (d)(4)], dissipation of residual energy [1910.147 (d)(5)(I)], and verification of isolation [1910.147 (d)(6)] were not implemented to protect employees from machine servicing hazards.

29 CFR  1904.29(b)(3):  Each recordable injury or illness was not entered on the OSHA 300 Log and on an incident report (OSHA Form 301 or equivalent) within seven (7) calendar days of receiving information that a recordable injury or illness had occurred.  a.  On or about March 8, 2023, a recordable injury occurred when an employee assembling guardrails on each side of an energized conveyor belt sustained lacerations and contusions to left hand, resulting in 14 days away from work.  The employer did not record the injury on an OSHA Form 300, OSHA 301, or their equivalent forms within the seven (7) calendar day requirement.
