29 CFR 1926.501(b)(1):"Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) On or about 05/23/2023, during the erection of a commercial building at Ogden Mills Business Center, located on 3900 Buffalo Road, in Rochester, New York, the employer did not enforce the use of fall protection when employees were constructing the building framework. Employees were allowed to work along unprotected sides, 10 feet above lower levels, without fall protection and were exposed to fall hazards. NO ABATEMENT CERTIFICATION REQUIRED
