29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  (a)Chokan Exteriors, LLC at 505 South Wheatland Avenue, Sioux Falls, SD 57106:  On or about and at times prior to May 24, 2023, the employer did not ensure that employees were protected from flying particles associated with operating pneumatic nail guns while conducting roofing operations on a multi-family residential apartment complex.  This condition exposed employees to eye injuries including the introduction of foreign particles into the eye.

29 CFR  1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  (a)Chokan Exteriors, LLC at 505 South Wheatland Avenue, Sioux Falls, SD 57106:  On or about and at times prior to May 24, 2023, the employer did not ensure that employees were protected from fall hazards, in that employees were conducting roofing operations on a 4:12 pitch, multi-family residential property without the use of fall protection systems.  This condition exposed employees to fall hazards greater than six feet.  Chokan Exteriors, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1630493, citation number 1, item number 2 and was affirmed as a final order on March 14, 2023 , with respect to a workplace located at 5005 West Equestrian Place, Sioux Falls, SD 57106.
