29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a.  On or about May 23, 2023, at the above addressed jobsite, employees required to operate a LULL 644B-37 Telehandler had not been trained and evaluated on the safe operation of the powered industrial truck, thereby exposing employees to vehicle tip-over, struck-by, and crushed-by hazards.

29 CFR  1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:  a.  On or about May 23, 2023, at the above addressed jobsite, an employee performing masonry operations from a platform raised, thirteen (13) feet two (2) inches above ground, by the forks of a LULL  644B-37 Telehandler, did not have the platform attached to the forks, thereby exposing the employee to fall hazards.

On or about May 23, 2023, at the above addressed jobsite, an employee performing masonry operations from a platform raised, thirteen (13) feet two (2) inches above ground, by the forks of a LULL 644B-37 Telehandler, was not utilizing a personal fall arrest system, thereby exposing the employee to fall hazards.
