29 CFR  1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:   a) East Baking, dba Lakeside Baking Company Inc.,306 Lakeside Road, Syracuse, NY  13209.  On or about 6/1/2023, the employer did not develop and implement a monitoring program to identify employees for the inclusion in the hearing conservation program.  An operator, working in the Mixing Area was exposed to continuous noise at a level of 111.4 percent of the OSHA permissible exposure limit, during 479 minutes of monitoring.   The equivalent dBA for 111.4 percent dose is approximately 90.78 dBA calculated as the 8-hour time weighted sound pressure level.   The employee was wearing PIP Foam Ear Plugs with a Noise Reduction Rating of 32 dB.  b) East Baking, dba Lakeside Baking Company Inc.,306 Lakeside Road, Syracuse, NY  13209.  On or about 6/1/2023, the employer did not develop and implement a monitoring program to identify employees for the inclusion in the hearing conservation program.   An operator, working in the Oven Area was exposed to continuous noise at a level of 98.85 percent of the OSHA permissible exposure limit, during 479 minutes of monitoring. The equivalent dBA for 98.84 percent dose is approximately 89.92 dBA calculated as the 8-hour time weighted sound pressure level.   The employee was wearing PIP Foam Ear Plugs with a Noise Reduction Rating of 32 dB.  East Baking, dba Lakeside Baking Company was previously cited for a violation of a similar occupational safety and health standard, 29 CFR 1910.95(d)(1)(i), which was contained in OSHA inspection number 1587652, citation number 1, item number 1b and was affirmed as a final order on 10/12/2022, with respect to a workplace located at 306 Lakeside Road, Syracuse, NY  13209.

On or about 6/1/2023, the employer did not establish and maintain an audiometric testing program to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels. 29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (n) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a) East Baking, dba Lakeside Baking Company Inc.,306 Lakeside Road, Syracuse, NY  13209.  On or about 6/1/2023, an operator, working in the Mixing Area was exposed to continuous noise at a level of 111.4 percent of the OSHA permissible exposure limit, during 479 minutes of monitoring.   The equivalent dBA for 111.4 percent dose is approximately 90.78 dBA calculated as the 8-hour time weighted sound pressure level.   The employee was wearing PIP Foam Ear Plugs with a Noise Reduction Rating of 32 dB.  Abatement methodology:  Step 1: An effective hearing conservation program in accordance with 29 CFR 1910.95(c) through (n) shall be maintained. An effective hearing conservation program shall include, at a minimum:  (1) A baseline audiogram for all employees exposed to noise levels equal to or in excess of the standard. (2) Annual audiograms for each overexposed employee. (3) Analysis of audiogram results with retesting and/or referral to an otolaryngologist or qualified physician when a significant threshold shift occurs. A significant shift will be considered to be equal to or greater than an average of 30 dba over the 2000, 3000, and 4000 hertz frequencies. (4) Where insert ear plugs or custom-molded devices are utilized, individual employee fitting shall be conducted by a trained person, and employees shall be instructed in the care and use of the devices.  East Baking, dba Lakeside Baking Company was previously cited for a violation of this occupational safety and health standard 29 CFR 1910.95(c)(1), which was contained in OSHA inspection number 1587652, citation number 1, item number 1a and was affirmed as a final order on 10/12/2022, with respect to a workplace located at 306 Lakeside Road, Syracuse, NY  13209.
