29 CFR  1926.453(b)(2)(v):A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  (a) On or about June 2, 2023, at the jobsite at 1124 W. Wilson, Chicago, IL 60640, an employee cleaning and applying mortar to a brick wall was operating a boom lift at approximately 15 feet above the concrete sidewalk below and was not wearing a body belt with lanyard to prevent exposure to fall hazards.

29 CFR  1926.1153(f)(1): The employer allowed dry sweeping or dry brushing where such activity could contribute to employee exposure to respirable crystalline silica and wet sweeping, HEPA-filtered vacuuming or other methods were feasible:  (a) On or about June 2, 2023, at 1124 W. Wilson, Chicago, IL 60640, employees were dry sweeping brick and mortar dust containing 10% silica (quartz).

29 CFR  1926.1153(g)(1):The employer did not establish and implement a written exposure control plan:  (a) On or about June 2, 2023, at 1124 W. Wilson, Chicago, IL 60640, the employer did not establish and implement a written exposure control plan that outlined at least the following elements: descriptions of the tasks that can expose employees to silica, descriptions of the work practices, respiratory protection, engineering controls, descriptions of housekeeping measures, and if necessary, procedures to limit access to areas to reduce employee exposure to crystalline silica. Employees were exposed to dust containing up to 10% crystalline silica (quartz) when removing bricks and mortar from second story window lentils.   Hazael Ledezma dba H&L Masonry, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1153(g)(1) which was contained in OSHA inspection number 1636199, citation number 1, item number 3, and was affirmed as a final order on May 17, 2023, with respect to a workplace located at 1235 W Granville Avenue, Chicago, IL 60660.
