29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: (a) On or about June 7, 2023, employees using a 20-foot Werner aluminum extension ladder on the right of the house placed with its side rails approximately eighteen inches above the roofline were exposed to a fall hazard of approximately eight feet to the ground below while accessing and egressing the roof. (b) On or about June 7, 2023, employees using a 20-foot Werner aluminum extension ladder was placed at the front of the house with its side rails approximately eighteen inches above the roofline were exposed to a fall hazard of approximately eight feet to the ground below while accessing and egressing the roof.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: (a) On or about June 7, 2023, an employee was exposed to a struck-by hazard to the eyes by not wearing eye protection when using a nail gun when doing roofing work. (b) On or about June 7, 2023, an employee was exposed to a struck-by hazard to the eyes by not wearing eye protection when working below those doing roofing work above and throwing down trash and debris. Juan Carlos Salazar was previously cited for a serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1564488, citation number 1, item number 1, and was affirmed as a final order on January 21, 2022, with respect to a workplace located at 1101 Old Oaks Dr, Forney, TX 75126.
