29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a) On or about June 7, 2023, employees installing roofing on top of a two-story house were not protected from a fall hazard of up to approximately seventeen (17) feet.  Miguel Angel Membreno was previously cited for a serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1532999, citation number 1, item number 2, and was affirmed as a final order on December 6, 2021, with respect to a workplace located at 3128 Glazer Rd, Forney, TX 75126.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) On or about June 7, 2023, employees using a 16-foot Werner aluminum extension ladder on the front of the house placed with its side rails approximately six inches above the roofline were exposed to a fall hazard of approximately nine feet to the concrete drive/walk below while accessing the roof.  (b) On or about June 7, 2023, employees using 16-foot Werner aluminum extension ladder on the side of the house placed with its side rails approximately ten inches above the roofline were exposed to a fall hazard of approximately eight feet to the ground below while accessing the roof.  (c) On or about June 7, 2023, employees using a Werner aluminum extension ladder at the back of the house placed with its side rails approximately two feet above the roofline were exposed to a fall hazard of approximately seventeen feet to the ground below while accessing the roof.  Miguel Angel Membreno was previously cited for a serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1532999, citation number 1, item number 3, and was affirmed as a final order on December 6, 2021, with respect to a workplace located at 3128 Glazer Rd, Forney, TX 75126.
