OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of hearing loss and being struck-by fragments of Polyvinyl Chloride (PVC) plastic pipe in the event the pipe ruptured:  At a worksite located at 30841 HWY 5, Lebanon, MO:   Employees engaged in sawmill activities were exposed to struck-by and rupture hazards. This was most recently documented on or about June 8, 2023, and at times prior to, when employees were using compressed air contained in PVC plastic piping in exposed above-ground areas to transport compressed air at approximately 120 psi. Compressed air is used as part of the manufacturing process, as well as for cleaning purposes.  AMONG FEASIBLE ABATEMENT METHODS INCLUDED BUT ARE NOT LIMITED TO:  a.	PVC lines can be encased in a material that would contain a rupture if it were to occur. b.	Replace PVC piping and fittings with metal piping and fittings, which are rated to transport compressed air in exp9osed above ground locations. c.	Replace PVC piping and fittings with Acroylonitrile-Butadiene Styrene (ABS) pipes and fittings, which are shatter resistant and manufactured for above ground use of compressed air. d.	Follow the OSHA SHIB on the Use of Polyvinyl Chloride (PVC) Pipe in Aboveground Installations, dated May 20, 1988; Hazard Alert Letter recommendation by the Industrial Commission of Arizona, Division of Occupational Safety & Health, dated May 26, 1988 (within the OSHA SHIB); Plastics Pipe Institute's Recommendation B, titled "Thermoplastic Piping for the Transport of Compressed Air or Other Compressed Gases," adopted January 19, 1972 (within the OSHA SHIB). e.	Follow the guidelines in ASME B31.8-2016 -- "Gas Transmission and Distribution Piping Systems," Section 842.3.3, Installation Provisions and Section 849.4.2, Installation of Plastic Service Lines. f.	ASME B31.3-2016, Process Piping, Section A323.4.2 Specific Requirements, (a) Thermoplastics. g.	Follow the manufacturer's recommendations from the online Important Safety Information -- Safety Graphics document (updated June 22, 2022), Warnings W-3, W-4, 2-5, W-12, W-22, W-26, W-37, and Notice N-37

29 CFR  1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces were kept in a clean, orderly, and sanitary condition.  At a worksite located at 30841 HWY 5, Lebanon, MO:  Employees were exposed to fire and explosion hazards. This was most recently documented on or about June 8, 2023, and at times prior to, when the employer did not provide walking-working surfaces that were free of hazards such as accumulation of sawdust.  Dry sawdust, a combustible and explosive dust, was observed in the facility on elevated surfaces at a depth greater than 1.5 inches.

This was most recently demonstrated on or about June 8, 2023, and at times prior to when workers were using chemicals in the workplace as part of the manufacturing process and the employer had not developed or implemented a written hazard communication program.

This was most recently demonstrated on or about June 8, 2023, and at times prior to, when workers were exposed to physical and health-related hazards; including but not limited to flying wood particles, falling wood boards or large pieces, liquid chemicals, wood dust, and noisy equipment in the workplace as part of the manufacturing process. The employer had not verified that a hazard assessment had been performed at the facility through a written certification.
