29 CFR 1910.28(b)(1)(i): Unprotected sides and edges. Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: (A) Guardrail systems; (B) Safety net systems; or (C) Personal fall protections systems, such as personal fall arrest, travel restraint, or positioning systems.  On or about July 18, 2023, at an establishment located at 2099 Badgerland Drive in Green Bay, Wisconsin, on the southernmost tallow railcar loadout area; the employer did not ensure that each employee utilizing the sliding catwalk to get on top of tallow railcars was protected from falling approximately 13 feet 6 inches to the hard ground surface. The swinging top rails affixed on either side of the catwalk were not secured in place immediately after extending the platform and prior to the employee accessing the catwalk.

29 CFR 1910.132(a): Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.   On or about May 24, 2023, to June 13, 2023, at an establishment located at 2099 Badgerland Drive in Green Bay, Wisconsin, in the South and North Loadout areas; the employer did not select and have each affected employee use a form of fall protection that would protect the employees from fall hazards into and off of the hopper railcars while loading meat and bone meal into the hopper railcars. Employees were exposed to a fall hazard of approximately 14 feet 11.5 inches while performing loadout activities.

29 CFR 1910.132(f)(1): The employer shall provide training to each employee who is required by this section to use PPE. Each such employee shall be trained to know at least the elements outlined in 29 CFR 1910.132(f)(1)(i) through 1910.132(f)(1)(v).  On or about June 13, 2023, and at times prior, at an establishment located at 2099 Badgerland Drive in Green Bay, Wisconsin, in the North and South Loadout areas; the employees were not trained in the elements required by this section when using PPE such as, but not limited to, the horizontal lifeline system employees used while loading meat and bone meal into the hopper railcars. Employees were exposed to falling into the railcars and becoming engulfed in the material and exposed to a fall hazard of approximately 14 feet 11.5 inches off the sides of the railcars to the hard ground surface below.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.  On or about May 20, 2023, to June 7, 2023, at an establishment located at 2099 Badgerland Drive in Green Bay, Wisconsin;  employees were exposed to hazards related to powered industrial vehicle operation while utilizing Snorkel #32025 which did not have a functioning driver's seat belt and had malfunctioning windshield wipers.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.  On or about May 20, 2023, to June 2, 2023, at an establishment located at 2099 Badgerland Drive in Green Bay, Wisconsin; the employer did not ensure that Snorkels (#32025 & 32027) used on a round-the-clock basis were examined after each shift to identify any condition that could adversely affect the safety of the vehicles such as, but not limited to, malfunctioning seatbelts, headlights, brakes, and windshield wipers.
