29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a)Angel Lopez at 4301 Solberg Avenue, Sioux Falls, SD 57106. On or about and at times prior to June 13, 2023, the exposing employer did not ensure that frequent and regular inspections were conducted by a competent person. This condition exposed employees to various hazards such as fall hazards, lack of Personal Protective Equipment (PPE), ladder hazards, and a lack of training.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  (a)Angel Lopez at 4301 Solberg Avenue, Sioux Falls, SD 57106: On or about and at times prior to June 13, 2023, the exposing employer did not ensure that employees were utilizing appropriate eye protection while performing roofing operations with pneumatic nail guns.  This condition exposed employees to eye injuries including the introduction of foreign particles into the eye while working.

29 CFR  1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a)Angel Lopez at 4301 Solberg Avenue, Sioux Falls, SD 57106. On or about and at times prior to June 13, 2023, the exposing employer did not ensure that a portable ladder being used for access to the roof of a multi-family residential property was extended at least three feet above the upper landing surface of the roof. This condition exposed employees to fall hazards associated with ladders.
