OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and crush by hazards:  a) 1550 Landmeier Road, Elk Grove Village Parking/Dock- On or about June 21, 2023, employees were exposed to fall hazards while riding on the elevated forks of a traveling Toyota sit down forklift and being lifted onto an open Republic 20 yard roll off dumpster.

29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by a guardrail system, safety net systems, and/or personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems:  a) 1550 Landmeier Road, Elk Grove Village Parking/Dock- On or about June 21, 2023, the employer did not provide an effective means to prevent employees from falling four or more feet to the ground when employees were standing on the edge and loading material in the open Republic 20 yard roll off dumpster, that was approximately 5 feet above ground level.   No abatement certification or documentation is required for this item.

29 CFR  1910.178(m)(3): Unauthorized personnel were permitted to ride on industrial truck(s):  a) 1550 Landmeier Road, Elk Grove Village Parking/Dock- On or about June 21, 2023, the employer did not ensure that only authorized personnel were permitted to ride on the Toyota sit down forklift. Employees were riding on the side of the Toyota sit down forklift while holding onto the overhead guard.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery was not adequately guarded to prevent employee(s) from having any part of their body in the danger zone(s) during the operating cycle(s):   a) 1550 Landmeier Road, Elk Grove Village Fabrication/Production - On or about June 6, 2023, the employer did not ensure that the point of operation on the APB Machinery Punch Presses were adequately guarded in a manner that would prevent employees from having any part of their body in the danger zone during the operating cycle.  b) 1550 Landmeier Road, Elk Grove Village Production- On July 3, 2023, the employer did not ensure that the Clausing 20 Drill Press was guarded in a manner that would protect employees from rotating parts, flying chips, and from having any part of their body in the danger zone during operation.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

29 CFR  1910.178(a)(5):The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:  a) 1530 Landmeier Road, Elk Grove Village Warehouse - On or about June 13, 2023, the employer did not obtain the manufacturer's written approval prior to modifying the Toyota Sit Sown Forklift by attaching a boom.  The data plate on the Toyota sit down forklift, Model 7FGCU55, Serial No. 60749, was not marked to identify the attachment, and did not show the capacity weight of the truck and attachment combination.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
