29 CFR 1910.119(f)(1)(iii)(E): The employer did not develop and implement written operating procedures that provided clear instructions for safely conducting activities involved in each covered process consistent with the process safety information and did not address any special or unique hazards:  At the facility located a 3019 Scanlan Avenue, Salina, Kansas, the employer failed to include in the standard operating procedures for the Evaporative Condensers the cable locked valves as a critical safety valve.  Employees and contractor employees using the Evaporative Condenser standard operating procedures for the ammonia refrigeration system were not provided with a description of the safety critical valves being included in the procedure.  Employees engaged in operating, inspecting, testing, and maintaining activities in the ammonia refrigeration system at the facility were exposed to catastrophic release of ammonia which results in asphyxiation, explosion and flash fire leading to death and injury.

29 CFR 1910.119(h)(2)(i):  The employer, when selecting a contractor, did not obtain and evaluate information regarding the contract employer's safety performance and program:  At the establishment located at 3019 Scanlan Avenue, Salina, Kansas, the employer failed to obtain the safety and health programs of the ammonia contactor that delivers and participates in the unloading of highly hazardous chemicals into the ammonia refrigeration system.  The driver of the ammonia tanker truck used their company's hoses and equipment to transfer the highly hazardous chemical.  Employees engaged in operating, inspecting, testing, and maintaining activities in the ammonia refrigeration system at the facility were exposed to catastrophic release of ammonia which results in asphyxiation, explosion and flash fire leading to death and injury.

The employer shall correct deficiencies in equipment that are outside acceptable limits before further use or in a safe and timely manner when necessary means are taken to assure safe operation.  The employer failed to repair an ammonia pipe hanger support above the Accumulator in room 901 located at 3910 Scanlon Avenue, Salina, Kansas. One side of the ammonia pipe hanger support was no longer connected to the mounting plate.  Employees engaged in operating, inspecting, testing, and maintaining activities in the ammonia refrigeration system at the facility were exposed to catastrophic release of ammonia which results in asphyxiation, explosion and flash fire leading to death and injury.

29 CFR 1910.305(g)(1)(iv)(A):  Flexible cords and cables were used as a substitute for fixed wiring of a structure:  Along the south wall of the ammonia refrigeration engine room an extension cord was placed behind column posts to power a WIFI repeater located at 1701 Shilling Road, Salina Kansas.  Employees were exposed to electrical burn hazards due to the extension cord being used as a substitute for fixed wiring.
