29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) On or about June 15, 2023 employees were exposed to a fall hazard of approximately 20 feet while performing roofing activities on a residential home located at 28625 Bassett Road, Westlake, OH . Employees were using an extension ladders to access the roof and the employer did not ensure they extended at least 3 feet above the upper landing surface.

29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) On or about June 15, 2023 at the location of 28625 Bassett Road, Westlake, OH: The employer did not ensure that employees performing roofing activities on a steep slope roof were protected from fall hazards. Employees were exposed to fall hazards of 20 feet to the ground below while performing roof tear off and shingle replacement. Melvin Mejia was previously cited for a violation of this occupational safety and health standard, 1910.501(b)(13), which was contained in OSHA inspection number 1509916, citation number 1, item number 1, and was affirmed as a final order on 03/02/2021 with respect to a workplace located at 2101 Wager Road, Rocky River, Ohio.
