29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) At the job site located at 19459 S. Amherst St. Gardner, KS, employees engaged in residential framing activities were exposed to chemical hazards in that a written hazard communication program had not been developed, implemented and maintained at the job site. Employees were handling DAP ALEX PLUS all-purpose acrylic latex caulk plus silicone, DAP SmartBond subfloor construction adhesive foam, and DAP DYNAGRIP 4000 subfloor construction adhesive. The chemical hazards associated with these products include: skin and eye irritation, drowsiness and/or dizziness, vomiting and/or diarrhea; nose, throat, lung and respiratory tract irritation; kidney, liver, brain and nervous system damage; and may be fatal if inhaled or ingested. Additionally, DAP SmartBond subfloor construction adhesive foam and DAP DYNAGRIP 4000 subfloor construction adhesive, can both act as a fueling agents due to their extreme flammability as a liquid and vapor/gas.

29 CFR 1910.1200(g)(1): Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use: (Construction Reference: 1926.59) At the job site located at 19459 S. Amherst St. Gardner, KS, employees engaged in residential framing activities were exposed to chemical hazards in that they were not provided access to the Safety Data Sheets (SDSs) for DAP ALEX PLUS all-purpose acrylic latex caulk plus silicone, DAP SmartBond subfloor construction adhesive foam, and DAP DYNAGRIP 4000 subfloor construction adhesive at the job site.
