29 CFR 1910.147(c)(4)(ii):The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following: On or about June 20, 2023, the employer failed to ensure the energy control procedure for the Faircrest Steel Plant Vertical Caster West Tundish Car clearly and specifically outlined the specific procedural steps for shutting down, isolating, and securing the scissors lift type manlift machine attached to the West Tundish Car [per 1910.147(c)(4)(ii)(B)], included specific procedural steps for the placement and removal of lockout devices for the scissors lift [per 1910.147(c)(4)(ii)(C)], and included specific requirements for testing the scissors lift to determine and verify the effectiveness of the lockout devices and energy control measures [per 1910.147(c)(4)(ii)(D)], for employees and/or outside personnel (contractors) engaged in service and maintenance activities, such as but not limited to, modifying the West Tundish Car.

29 CFR 1910.147(d):Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence: On or about June 20, 2023, the employer failed to ensure employees and/or outside personnel (contractors) performing service and maintenance activities by modifying the Faircrest Steel Plant Vertical Caster West Tundish Car applied hazardous energy control by; turning off or shutting down the scissors lift machine attached to the West Tundish Car platform [per 1910.147(d)(2)], isolating the scissors lift machine from the electrical energy source(s) [(d)(3)], affixing lockout device(s) to the energy isolation device(s) of the scissors lift machine [(d)(4)(i), and verifying de-energization and isolation of the scissors lift machine had been accomplished [(d)(6)], prior to modifying the West Tundish Car.

On or about June 20, 2023, the employer failed to conduct an adequate periodic inspection of the developed and documented energy control procedure for the Faircrest Steel Plant Vertical Caster West Tundish Car to correct any inadequacies in the procedure [per 1910.147(c)(6)(i)(B)] and/or include a review, between an inspector and each authorized employee, of that employees responsibilities under the energy control procedure [per 1910.147(c)(6)(i)(C)], to ensure the procedure and the requirements of the standard were being followed by employees.
