29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a. Location: Prefabrication Area (Wall assembly) On August 10, 2023, an employee who was operating pneumatic nail guns and routers during prefabrication of shed walls was exposed to noise levels at 71.42% of the allowable 8 hour time weighted average sound level (80 dBA). The equivalent level of the 71.42% is approximately 87.5 dBA which is capable of causing permanent hearing loss. The sampling was performed for 473 minutes during one work shift on August 10, 2023. Zero exposure was assumed for the unsampled time period of 7 minutes. The employer had not implemented a hearing conservation program as described above for all employees exposed to noise levels greater than 85 dBA. b. Location: Prefabrication Area (Trim) On August 10, 2023, an employee who was operating pneumatic nail guns and routers during prefabrication of shed walls was exposed to noise levels at 66.69% of the allowable 8 hour time weighted average sound level (80 dBA). The equivalent level of the 66.69% is approximately 87.0 dBA which is capable of causing permanent hearing loss. The sampling was performed for 480 minutes during one work shift on August 10, 2023. The employer had not implemented a hearing conservation program as described above for all employees exposed to noise levels greater than 85 dBA.
