29 CFR 1926.501(a)(2): The employer did not determine if the walking/working surfaces, on which its employees were to work, had the strength and structural integrity to support employees safely: a) 231 South Madison Ave, Dunellen, NJ 08812, exterior fire escape; The employer did not assess the structural integrity of the fire escape in order to determine if it had requisite strength to safely support the weight of employee(s) allowed to work atop of it. Support member fastener(s) of the upper landing failed while a demolition contractor employee stood atop of it while torch-cutting railing(s), causing the employee to fall 15 feet to the ground below. Incident occurred on or about 6/23/2023.

29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment were not independent of any anchorage being used to support or suspend platforms and/or were not capable of supporting at least 5,000 pounds (22.2 kN) per employee: a) 231 South Madison Ave, Dunellen, NJ 08812, exterior fire escape;- Two employees were preforming demolition and removal of a fire escape; one of whom was standing on the upper landing of the structure which had an open-sided edge where the safety railing was previously removed. His personal fall arrest system anchorage was a clamp inside the building that did not support his weight; causing him to fall 15 feet to the ground below when the fire escape structure collapsed. Incident occurred on 6/23/2023.
