29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  On or about 06/29/2023 at 7975 NW 54th St. Doral, FL 33166, the employer did not develop and implement a written respiratory program for those employees required to wear respiratory protection, including 3M Half Facepiece Reusable Respirator 6300/07026 and Comfort Ease N95 AD2N95A filtering facepiece respirators while fabricating marble, corsite, porcelain, and quartz.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.  On or about 06/29/2023 at 7975 NW 54th St. Doral, FL 33166, the employer did not provide medical evaluations for employees who were required to wear 3M Half Facepiece Reusable Respirator 6300/07026 and Comfort Ease N95 AD2N95A filtering facepiece respirators while fabricating marble, corsite, porcelain, and quartz.

29 CFR 1910.1200(g)(8):  The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work shift to employees when they were in their work area(s):  On or about 06/29/2023 at 7975 NW 54th St. Doral, FL 33166, the employer did not ensure effective measures for communication about hazardous chemical information to employees due to not maintaining copies of safety data sheets for every hazardous chemical in the workplace including, but not limited to, GE500 silicone sealant, acetone, DOMOCOMB A+B epoxy, and muriatic acid, and not ensuring all safety data sheets were readily accessible to employees who use these while fabricating stone.
