29 CFR 1910.178(p)(1):Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s) a) Receiving/Inbound Area and Shipping/Outbound Area; On or about June 30, 2023 and at times prior, the employer exposed employees to electrical and struck by hazards, in that a standup forklift (Model: Crown RC5545-40; Serial Number: 1216141/1A477573) was not taken out of service or in safe and operative condition, as the forklift contained exposed live wires connected to the hydrogen battery. b) Receiving/Inbound Area and Shipping/Outbound Area; On or about June 30, 2023 and at times prior, the employer exposed employees to struck by hazards, in that a standup forklift (Model: Crown RC5545-40; Serial Number: 1216141/1A477573) was not taken out of service or in safe and operative condition, as the forklift contained an exposed hydraulic line. c) Receiving/Inbound Area and Shipping/Outbound Area; On or about June 30, 2023 and at times prior, the employer exposed employees to struck by hazards, in that a standup forklift (Model: Crown RC5545-40; Serial Number: 1216141/1A477573) was not taken out of service or in safe and operative condition, as the front left and right tires have a loss of mass. d) Receiving/Inbound Area and Shipping/Outbound Area; On or about June 30, 2023 and at times prior, the employer exposed employees to struck by hazards, in that a standup forklift (Model: Crown RC5545-40; Serial Number: 1214149/1A427662) was not taken out of service or in safe and operative condition, as the forklift contained an error on the User Interface related to the hydrogen battery.
