29 CFR 1926.20(b)(2): The employer did not ensure for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employer:  (a)Marvin Alvarado LLC at 4101 West Valhalla Boulevard, Sioux Falls, SD 57106: On or about and at times prior to July 7, 2023, the exposing employer did not ensure that frequent and regular inspections were conducted by a competent person.  Employees were conducting roofing operations with no fall protection systems in place as well as a lack of training prior to being exposed to the fall hazards. This condition exposed employees to fall hazards and a lack of training to recognize and correct hazards.

29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:  (a)Marvin Alvarado LLC at 4101 West Valhalla Boulevard, Sioux Falls, SD 57106: On or about and at times prior to July 7, 2023, the exposing employer did not ensure employees were protected from fall hazards while conducting roofing activity on a 4/12 low slope commercial property. This condition exposed employees to falls greater than six feet while working on site.  Marvin Alvarado LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(11), which was contained in OSHA inspection number 1440555, citation number 1, item number 1 and was affirmed as a final order on November 27, 2019, with respect to a workplace located at 3307 3rd Avenue North, Billings, MT 59101.

29 CFR  1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer:  (a)Marvin Alvarado LLC at 4101 West Valhalla Boulevard, Sioux Falls, SD 57106: On or about and at times prior to July 7, 2023, the exposing employer did not ensure that fall protection training was documented prior to employees being exposed to the fall hazards. This condition exposes employees to not being properly trained on fall protection and fall hazards.
