OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to struck by and or struck against injuries while working in a scissor lift which was not properly inspected or maintained as required by the manufacturer to ensure the platform control panel was secured: a) On or about 07/10/2023, during the "ground-up" construction of the Bank of America , located at 1500 Hudson Avenue, in Rochester, New York, the employer did not enforce operator safety practices for employees operating a scissor lift (SkyJack SJ 6832 RT). Employees were allowed to operate a scissor lift without performing a visual inspection of the lift and without reading the operating manual as required by the manufacturer. Employees were exposed to struck by and or struck against hazards due to an unsecured platform control console, which was not secured in place with the provided locking pin. The unsecured platform control console could drop and activate the controls causing the lift to move unexpectedly. NO ABATEMENT CERTIFICATION REQUIRED
