29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: a) On or about 07/11/2023, at the Draper Center, located on 1326 University Avenue, in Rochester, New York, the employer did not enforce the use of fall protection during the roof restoration process of an existing roof. The employer allowed employees to work on a roof 20 feet above lower levels without fall protection exposing them to fall hazards. NO ABATEMENT CERTIFICATION REQUIRED The employer Weathertight Installations, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(10), which was contained in OSHA inspection number 1653037, citation number 1, item number 1 and was affirmed as a final order on 05/04/2023, with respect to a workplace located at 4152 West Main Street, Batavia, NY.
