29 CFR  1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.   a) On July 13, 2023, located at a 2-story commercial structure, the employer failed to ensure that employees were utilizing a ladder or other authorized means of access to the upper platform levels of a steel tubular frame scaffold. As a result, at least one employee was exposed to a fall hazard of approximately 13 feet 6 inches above ground level.

29 CFR  1926.451(g)(1)(vi):Each employee performing overhand bricklaying operations from a supported scaffold shall be protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity).  a) On July 13, 2023, located at a 2-story commercial structure, the employer failed to ensure that employees were utilizing a fall protection system while performing brick laying work at the working platform level of a steel tubular frame scaffold. As a result, employees were exposed to a fall hazard of approximately 13 feet 6 inches above ground level.

29 CFR  1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:   a) On July 13, 2023, located at a 2-story commercial structure, the employer failed to provide an effective training program for employees performing elevated bricklaying work from a steel tubular frame scaffold. As a result, at least one employee was exposed to a fall hazard of approximately 13 feet 6 inches above ground level.
