29 CFR  1910.157(e)(3):Portable fire extinguishers were not subjected to an annual maintenance check:  a) Outside of the Pesticide Storage Building near the entry door: An ABC portable fire extinguisher had not been recently inspected and it lacked a dated inspection tag.   b) Inside of the Pesticide Storage Building: An ABC portable fire extinguisher had not been recently inspected and the last date found on the inspection tag was March 2019.   c) Between the bay door and the exit door of the Shop Building: An ABC  portable fire extinguisher had not been recently inspected and it lacked a dated inspection tag.

29 CFR  1910.1200(f)(6):The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information specified under paragraphs (f)(6)(i) through (ii) of this section:  a) Pesticide Storage Building: A one gallon plastic container containing Garlon 4 Herbicide did not have a proper label affixed to the container as to identify the contents and other required information.    b) Pesticide Storage Building: A plastic 3 to 5 gallon container used to store a mix of Garlon 4 Herbicide and JLB Oil was only identified by someone using a marker and scrawling on the side "Garlon 4 with JLB oil". There was no other information.

29 CFR  1910.1200(g)(1): Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use  a) Pesticide Storage Building: The employer did not establish and maintain a SDS that explained the hazards associated with exposure to chemical products such as, but not limited to Garlon 4 Herbicide, JLB Oil, Alligare 90 Surfactant, Rodeo Herbicide; and Mertect 340-F Fungicide. The employer had no readily available SDS on site.

29 CFR  1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition.  a) Pesticide Storage Building: The building was full of containers of pesticides scattered around the floor with some in cardboard boxes; which all showed water damage and many were falling apart. Also scattered about the floor were fiber poles, scrap wood, plywood and the floors and walls were covered with dirt and mildew.
