29 CFR 1910.134(e)(1): The employer failed to provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator. On or about July 18, 2023 the employer did not provide a medical evaluation program for employees who use respirators in the workplace including the 3M Half Facepiece and Full Facepiece Reusable Respirators with 3M Vapor Cartridges Pre-Filters and Cap. The employer requires employees to wear the respirators for operations including but not limited to mixing mortar mix by hand and abrasive blasting using the products Belden Brick, Spec Mix Portland Lime & Sand Mortar, and Quikrete Mortar Mix that contain hazardous chemicals including but not limited to Aluminum Silicates, Respirable Crystalline Silica, and Portland Cement.

29 CFR 1910.134(f)(2): The employer failed to ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter. On or about July 18, 2023 the employer did not provide an effective fit testing program to employees that were required to wear respirators including the 3M Half Facepiece and Full Facepiece Reusable Respirators with 3M Vapor Cartridges Pre-Filters and Cap. The employer requires employees to wear the respirators for certain operations. These operations include but are not limited to mixing mortar mix by hand and abrasive blasting using the products Belden Brick, Spec Mix Portland Lime & Sand Mortar, and Quikrete Mortar Mix that contain hazardous chemicals including but not limited to Aluminum Silicates, Respirable Crystalline Silica, and Portland Cement.

29 CFR 1926.1153(d)(2)(i): The employer failed to assess the exposure of each employee who is or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance or scheduled monitoring exposure assessments. On or about July 18, 2023 the employer failed to conduct an exposure assessment for respirable crystalline silica for employees who worked at the temporary sites 5619 Main Street, Sylvania, Ohio 43560 for tasks that contained silica dust including but not limited to mixing Spec Mix Portland Lime & Sand Mortar with water. This kind of mix contains hazardous respirable products including but not limited to Respirable Crystalline Silica Quartz and Portland Cement.
