29 CFR 1926.502(d)(15): Anchorage used for attachment for personal fall arrest equipment was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached nor was it designed, installed and used as follows: As part of a complete personal fall arrest system which maintains a safety factor of at least two; and under the supervision of a qualified person: (a) On July 12th, 2023, at 2900 North 4th Street Bismarck, ND, while re-shingling a residential roof 30 feet high, employees were exposed to fall hazards from improperly installed anchors where an anchor was installed with only 3 nails per side when the manufacturer requires at least 9 screws per side.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level: (a) On July 12th, 2023, at 2900 North 4th Street Bismarck, ND, an employee engaged in roofing operations on a 30-foot tall apartment complex fell from the roof and traveled 13 feet before being caught by his personal fall arrest system because his fall arrest system was not set to the correct length.
