29 CFR  1910.212(a)(1):Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.  a) On 6/26/2023 the employer did not ensure that the Accurshear Press (625010), where employees were working, was adequately guarded in that the guard for the point of operation was easily by passed due to having gaps less than 1.5"  between the guard and the hold down for the material exposing employees to a caught in hazard.     b) On or before 6/26/2023, the employer did not ensure that the backside of the Accurshear Press (625010), where employees were working, utilized adequate machine guarding method such as but not limited to, barrier guards, or electronic safety devices. In that employees were exposed to a moving chain and sprocket as employees set the Shearer's cutting size.
