OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause serious physical harm to employees, in that employees were not protected from the hazard of being struck-by or splashed by acid/caustic during plating/coating operations.   a) Anodize Plating Line, Welch Allyn Inc., 4341 State Street Road, Skaneateles Falls, NY 13153, on or about July 13, 2023, an employee was exposed to struck by hazards and acid/caustic splash hazard from falling objects due to use of a lifting device without any affixed and legible identification markings including a rated load. Lifting device did not have a load test to verify its safe working load. Lifting device was homemade by the employee.  b) Barrel Plating Line, Welch Allyn Inc., 4341 State Street Road, Skaneateles Falls, NY 13153, on or about July 13, 2023, an employee was exposed to struck by hazards and acid/caustic splash hazard from falling objects due to use of a lifting device without any affixed and legible identification markings including a rated load. Lifting device did not have a load test to verify its safe working load.

29 CFR 1910.147(c)(8): Lockout or tagout was not performed only by the authorized employees who are performing the servicing or maintenance:  a) Automatic Plating Machine, Welch Allyn Inc., 4341 State Street Road, Skaneateles Falls, NY 13153, on or about June 1, 2023:  An authorized employee was performing maintenance activities in the Automatic Plating Machine and did not personally and physically lockout the equipment at the source.   The authorized employee relied on another employee working in the Maintenance Department to lockout the equipment.

Lifting device was homemade by the employee.  b) Barrel Plating Line, Welch Allyn Inc., 4341 State Street Road, Skaneateles Falls, NY 13153, on or about July 13, 2023, an employee was exposed to struck by hazards and acid/caustic splash hazard from falling objects due to use of an unapproved lifting device. 29 CFR  1910.147(c)(7)(iii)(A):Retraining was not provided for authorized and affected employees when there was a change in their job assignments, a change in machines, equipment or processes that presented a new hazard, or when there was a change in the energy control procedures.  a) Welch Allyn Inc., 4341 State Street Road, Skaneateles Falls, NY 13153, on or about June 22, 2023, the employer changed the format and updated all of the energy control procedures across the facility from November 2022 through February 2023, including the creation of new equipment specific procedures, but did not retrain any of the authorized employees.
