The written program shall be available for inspection by employees and their authorized representatives: At a facility located at 41 Main Street, in Menasha, WI; the employer did not implement a written permit space program that complies with this section. Employees entered permit spaces and were not provided with means or procedures for emergency rescue when: a) On or about June 23, 2023, an employee entered the permit space of the Voss tunnel washer. b) On or about September 27, 2023, an employee entered the permit space of Girbau Dryer 1.

29 CFR 1910.146(d)(9): The employer shall develop and implement procedures for summoning rescue and emergency services, for rescuing entrants from permit spaces, for providing necessary emergency services to rescued employees, and for preventing unauthorized personnel from attempting a rescue: At a facility located at 41 Main Street, in Menasha, WI; the employer did not develop or implement compliant procedures for summoning rescue and emergency services, nor did they develop or implement procedures for rescuing entrant employees when they worked in permit spaces. The employer's procedures for summoning rescue and emergency services were to call the local fire department by dialing 911. The local fire department did not agree to act as the employer's permit-required confined space rescue service. a) On or about June 23, 2023, an employee entered the permit space of the Voss tunnel washer with noncompliant procedures for summoning rescue services and with no procedures for rescuing the entrant from the tunnel washer. b) On or about September 27, 2023, an employee entered the permit space of Girbau Dryer 1 with noncompliant procedures for summoning rescue services and with no procedures for rescuing the entrant from the dryer.

29 CFR 1910.146(k)(1)(i): An employer who designates rescue and emergency services, pursuant to paragraph (d)(9) of this section, shall evaluate a prospective rescuer's ability to respond to a rescue summons in a timely manner, considering the hazard(s) identified: At a facility located at 41 Main Street, in Menasha, WI; the employer determined that rescue and emergency services for permit-required confined space entry would be provided by the Neenah-Menasha Fire Rescue (NMFR). The employer did not evaluate the NMFR's ability to respond to a rescue summons in a timely manner when employees entered the permit-space of the Voss tunnel washer on or about June 23, 2023, and entered the permit space of the Girbau Dryer 1 on or about September 27, 2023.

29 CFR 1910.146(k)(3)(i): Each authorized entrant shall use a chest or full body harness, with a retrieval line attached at the center of the entrant's back near shoulder level, above the entrant's head, or at another point which the employer can establish presents a profile small enough for the successful removal of the entrant. Wristlets may be used in lieu of the chest or full body harness if the employer can demonstrate that the use of a chest or full body harness is infeasible or creates a greater hazard and that the use of wristlets is the safest and most effective alternative: On or about September 27, 2023 at a facility located at 41 Main Street, in Menasha, WI; an authorized entrants entered the permit space of the Girbau Dryer 1 and did not use a chest/full body harness, wristlets, or retrieval line for their removal from that permit space.
