29 CFR 1926.453(b)(2)(iv):Employees shall always stand firmly on the floor of the basket, and shall not sit or climb on the edge of the basket or use planks, ladders, or other devices for a work position. a) On or about 07/20/2023, during the construction of the Marketplace Senior Apartments, located on 1100 Miracle Mile Drive, in Rochester, New York, the employer did not enforce the safe operating use of an aerial lift during the application of exterior zip foam board. Employees were allowed to climb on the boom basket guardrails exposing them to fall hazards while working 15 feet above lower levels. NO ABATEMENT CERTIFICATION REQURIED
