29 CFR 1926.102(a)(1):The employer did not ensure that each affected employee use appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors or potentially injurious light radiation: On or about July 26 and July 28, 2023, the employer did not ensure employees were wearing any form of eye or face protection exposing them to a struck by hazard while using a pneumatic nail gun to install shingles on the roofs of a residential homes located at 860 Eagle Chase Drive Akron, OH 44313.

29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): The employer does not require the use of any form of fall protection during roofing work. This violation was most recently observed on July 26, 2023 and July 28, 2023, at a jobsite located at 860 Eagle Chase Drive Akron, OH 44313, where employees were not protected from fall hazards of 8-18 feet to the concrete covered ground. To abate this violation, the employer must ensure that employees performing roofing work are protected from falls, and that no employee is allowed onto a roof more than 6 feet high without adequate fall protection.
