29 CFR 1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met. On or about July 25, 2023 and preceding at the Military Ocean Terminal Concord C2 Alaska, LLC operations, the employer was unable to provide or identify the provisions of a written hazard communication program. Employees were exposed to irritant, flammable and corrosive hazards.

29 CFR 1910.1200(g)(1): Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use. At Building 350, Military Ocean Terminal Concord, on or about July 25, 2023, Safety Data Sheets for chemicals including Shop Pro Brake Cleaner and Compressed Oxygen could not be located by employees or the employer. Employees were exposed to projectile, flammable, irritant and other chemical exposure hazards.

29 CFR 1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: On or about July 25, 2023 and preceding, employees worked with a variety of chemicals and were subject to a variety of chemical hazards. Employees had not been trained on the contents of the hazard communication standard as required. Employees were exposed to corrosive burns, burns from fires from flammable chemicals, projectile hazards from compressed gas cylinders and irritation.
