29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: On or about July 26, 2023, employees engaged in commercial construction installation activities 6 feet or more above a lower level without the use of fall protection. This condition exposed employees to a fall hazard. NCC Structures, Inc. was previously cited for a violation of this occupational safety and health standard 1926.501(b)(10), which was contained in OSHA inspection number 1358939, citation number 1, item number 2 and was affirmed as a final order on December 27, 2018, with respect to a workplace located at 2400 S. Texas St. Pecos, TX 79772.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill. On or about July 26, 2023, employees engaged in commercial construction activities 6 feet or more above a lower level were not protected from fall hazards and demonstrated inadequacies in their knowledge by not utilizing personal fall protection. This condition exposed employees to fall hazards. NCC Structures, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.503(c)(3), which was contained in OSHA inspection number 1358939, citation number 1, item number 3 and was affirmed as a final order on December 27, 2018, with respect to a workplace located at 2400 S. Texas St. Pecos, TX 79772.
