Location: a) Tower Crane at 550 10th Avenue, New York 10018 At times prior to July 26, 2023, employer failed to have competent person onsite to perform an inspection of the crane for each shift as the crane operators did not note all equipment leakages on their daily inspection checklists.

29 CFR 1926.1412(d)(2): If deficiencies in paragraphs (d)(1)(iii)-(iv) of this section were identified, an immediate determination was not made by a competent person as to whether the deficiency constituted a safety hazard so as to remove the equipment out of service until it had been repaired/corrected. Location: a) Tower Crane at 550 10th Avenue, New York 10018 At times prior to July 26, 2023, the employer did not have a competent person on-site to determine whether crane deficiency constituted a safety hazard and the crane was not taken out of service for repair. At times prior to July 26, 2023, crane operators had observed on occasion during their shift inspections certain leakage on the crane and did not note all equipment leakages on their daily inspection checklist and did not recognize the leakage as a potential hazard.
