29 CFR  1926.102(a)(1): Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  a) Roof of Apartment Building #300: On 07/27/2023, the employer exposed employees to struck-by hazards while operating pneumatic roofing nail guns, in that employees were not provided with protective eyewear while operating these tools at over 120 PSI.

29 CFR  1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  a) Apartment Building #300: On 07/27/2023, the employer exposed employees to fall hazards of approximately 33-feet to the lower level, in that a fall protection system was not provided to employees engaged in roofing activities using the roof as a walking/working surface.  b) Apartment Building #300: On 07/27/2023, the employer exposed employees to fall hazards of approximately 31-feet to the lower level, in that a fall protection system was not provided to employees engaged in roofing activities using the roof as a walking/working surface.

29 CFR  1926.552(a)(1): The employer did not comply with the manufacturer's specifications and limitations applicable to the operation of all hoists and elevators.  a) Front of apartment building #300; On or about 07/27/2023, the employer exposed employees to struck-by hazards, in that the employer did not follow the manufacturer's specifications of the TranzSporter Platform Hoist  as the wire cable it was manufactured with was replaced using a rope.
