29 CFR  1910.94(a)(5)(i):  The employer did not use only respirators approved by the National Institute for Occupational Safety and Health (NIOSH) under 42 CFR part 84 to protect employees from dust produced during abrasive-blasting operations:  (a)JGM, Inc. dba JGM Fabricators & Constructors LLC located at 1201 Valley Road Coatesville, PA-Bay 1 and Bay 3: On or about July 26, 2023 and thereafter, the employer did not ensure that employees wear a NIOSH approved respirator during abrasive blasting operations. Employees  exposed to dusts produced during abrasive-blasting operations wore half-face respirators such as but limited to Miller LPR-100 With P100 filters.

29 CFR 1910.95(b)(1): When employees were subjected to sound exceeding those listed in Table G-16, feasible engineering controls were not utilized:   (a) JGM, Inc. dba JGM Fabricators & Constructors LLC located at 1201 Valley Road Coatesville, PA: The employer did not implement feasible administrative and/or engineering controls to reduce noise levels listed in Table G-16 of this standard for employees performing steel fabrication activities such as sandblasting. An employee was exposed to continuous noise levels equal to 576.1% of the allowable 100% dose for an 8-hour time-weighted average (TWA). This exposure was equivalent to an 8-hour TWA of 102.6 dBA, exceeding the OSHA Permissible Exposure Level of 90.0 dBA for an 8-hour TWA. Sampling time was 382 minutes. Zero exposures were assumed for all unsampled time periods.  Violation occurred on or about August 23, 2023

29 CFR 1910.95(c)(1): The employer did not administer a continuing and effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  (a) JGM, Inc. dba JGM Fabricators & Constructors LLC located at 1201 Valley Road Coatesville, PA: The employer did not administer a continuing, effective hearing conservation program for employees performing steel fabrication activities including but limited to welding and sandblasting. Employees were exposed to continuous noise levels equivalent to 70% and 87.7% of the allowable 50% dose for an 8-hour time-weighted average (TWA). These exposures were equivalent to an 8-hour TWA of 87.4 dBA and 89.0 dBA respectively, exceeding the OSHA Action Level of 85.0 dBA for an 8-hour TWA. Sampling times were 402 and 408 minutes. Zero exposures were assumed for all unsampled time periods.  Violation occurred on or about August 23, 2023

29 CFR 1910.1000(a)(2): Employee(s) were exposed to an airborne concentration of Total Dust (particulates not otherwise regulated) listed in Table Z-1 in excess of the 8-hour Time Weighted Average concentration of 15 milligrams per cubic meter as an 8-hour Time Weighted Average (TWA) concentration:  29 CFR  1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d):    (a) JGM, Inc. dba JGM Fabricators & Constructors LLC located at 1201 Valley Road Coatesville, PA-Bay 1 and Bay 3: The employer did not protect employees from airborne concentrations of particulates not otherwise regulated (total dust) listed in Table Z-1 in excess of 15 milligrams per cubic meter as an 8-hour Time Weighted Average (TWA) concentration. An employee performed abrasive blasting operations on carbon steel pieces was exposed to particulates not otherwise regulated (total dust) of 133.2339 milligrams per cubic meter as an 8-hour Time Weighted Average (TWA). Exposure is 8.8823 times the OSHA Permissible Exposure Limit (PEL) of 15 milligrams per cubic meter.  The employer did not ensure feasible engineering controls were implemented to reduce employee exposure to achieve compliance.     Violation occurred on or about August 23, 2023
