Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high ambient heat while performing jobs duties:  (a)Masaba, Inc. at 1617 317th Street, Vermillion, SD 57069:  On or about and at times prior to July 26, 2023, the employer did not ensure that employees were protected from heat related illnesses and injuries in that, an employee working in the blast booth was exposed to high indoor heat including high temperature and high humidity while wearing personal protective equipment during the performance of their duties and as a result  was hospitalized due to heat related illness. The outdoor temperature ranged from 70�F to 94�F according to the National Weather Service and was recorded to be 92 degrees F by Masaba on July 26, 2023, at 1:52 pm.  This condition was over the American Conference of Governmental Industrial Hygienists (ACGIH) TLF (threshold limit value) and AL (action limit) and exposed employees to serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, heat stroke, and death.

29 CFR  1910.252(b)(2)(iii): Workers and other persons adjacent to the welding area were not protected from the rays by noncombustible or flameproof screens or shields:  (a)Masaba, Inc. at 1617 317th Street, Vermillion, SD 57069:  On or about and at times prior to July 28, 2023, the employer did not ensure that welders or other employees passing through the welding area were properly protected from arc welding rays.  This condition exposed employees to ultra-violet radiation hazards associated with direct line of sight unguarded welding activities.  Masaba, Inc.  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.252(b)(2)(iii), which was contained in OSHA inspection number 1395288, citation number 1, item number 2 and was affirmed as a final order on October 16, 2019, with respect to a workplace located at 1617 317th Street, Vermillion, SD 57069.
