29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a)  Hercules Enterprises, LLC 321 Valley Road Hillsborough, NJ 08844  On or about July 31, 2023 and thereafter, the employer did not provide a medical evaluation for newer employees to determine their ability to use a respirator before requiring use.  The employer required employees to wear respirators while performing welding and painting operations.  Note:  The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.

The employer required employees to wear respirators while performing welding and painting operations.

29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  LOCATION:  Hercules Enterprises, LLC 321 Valley Road Hillsborough, NJ 08844  On or about July 31, 2023, Hercules Enterprises, LLC did not provide hazard communication training to employee(s) who use chemicals in the painting operation including hardener(s), paints & primers, as well as thinners / solvents such as acetone. Training and information was not provided on the flammable and inhalation health hazards of these chemicals.
