29 CFR  1926.150(c)(1)(vi):A fire extinguisher, rated not less than 10B, was not  provided within 50 feet of wherever more than 5 gallons of flammable or combustible liquids or 5 pounds of flammable gas are being used on the jobsite. This requirement does not apply to the integral fuel tanks of motor vehicles:  73 Belmont St., Easton, MA: On or about August 1, 2023, the worksite had more than 5 gallons of gasoline in portable plastic containers and there was no fire extinguisher on site, nor a hose as the commercial building was vacant.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:  73 Belmont St., Easton, MA: On or about August 1, 2023, employees were exposed to fall hazards are part of their assigned duties and the employer had not trained them prior to exposure to these hazards in topics such as but not limited to recognition of fall hazards, dangers of fall hazards and procedures each employee must take to prevent or minimize risk of such exposures.

Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not  protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.   73 Belmont St., Easton, MA: On or about August 1, 2023, employees were observed working on a low slope roof engaged in roofing activities on a roof with unprotected sides and edges greater than 25 feet to the next lower and were not protected by either guard rails, safety net systems, personal fall arrest systems, or flagging and monitor systems exposing them to fall from height hazards.  SMG Construction, which was the ERs previous company name since dissolved but using name as DBA,  was previously cited for a violation of an equivalent standard  CFR29 1926.501 (b) 13, which was contained in OSHA inspection number 1645115 citation 1 , item 3a  and was affirmed as a final order on 5/31/23 , with respect to a workplace located at 134 6th St., Lowell., MA.

29 CFR  1926.1053(b)(1):When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder:  73 Belmont St., Easton, MA: On or about August 1, 2023, the aluminum extension ladder being used to access the roof top work location did not extend the required 3 feet past that upper landing surface.  SMG Construction, which was the ERs previous company name since dissolved but using name as DBA was previously cited for a violation of this occupational safety and health standard29 CFR 1926 1053 (B) 1, which was contained in OSHA inspection number 1645115 , citation number1 , item number 4 and was affirmed as a final order on 5/31/23, with respect to a workplace located at 134 6th St., Lowell.
