29 CFR  1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, was not protected by protective helmets:  a. At a temporary, new construction, residential work site located at 3019 Ernest Street in Jacksonville, Florida 32205: On or about August 2, 2023, the employer exposed employees to struck-by hazards, in that protective helmets (hard hats) were not utilized by employees who worked underneath other employees who were bracing trusses.

29 CFR  1926.1053(b)(13): The top or top step of a stepladder shall not be used as a step:  a. At a temporary, new construction, residential work site located at 3019 Ernest Street in Jacksonville, Florida 32205: On or about August 2, 2023, the employer exposed an employee to slip, trip and fall hazards, in that an employee used the top step of a portable 6-foot A-frame step ladder to gain access and egress to and from the roof area.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a. On the roof, at a temporary, new construction, residential work site located at 3019 Ernest Street in Jacksonville, Florida 32205:  On or about August 2, 2023, the employer exposed an employee to eye injury hazards created by flying debris, in that eye protection was not utilized by the employee while operating a pneumatic nail gun.  b. At a temporary, new construction, residential work site located at 3019 Ernest Street in Jacksonville, Florida 32205:  On or about August 2, 2023, the employer exposed two employees to eye injury hazards created by flying debris, in that eye protection was not utilized by the employees while operating portable battery-operated circular saws to cut lumber.   BDM Construction and Repair, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1413085, citation number 01 item number 001 and was affirmed as a final order on January 29, 2020, with respect to a workplace located at 33128 Sawgrass Park Place, Lot 262, Unit 7A, Flora Parke, FL 32041.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, a personal fall arrest system, or an alternative fall protection measure as provided by another provision in paragraph (b) of this section:  a. On the roof truss area, at a temporary, new construction, residential work site located at 3019 Ernest Street in Jacksonville, Florida 32205: On or about August 2, 2023, the employer exposed an employee to fall hazards ranging from 6 to 16-foot, in that fall protection was not utilized by the employee while bracing trusses.   BDM Construction & Repair, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1413085, citation number 01, item number 002 and was affirmed as a final order on January 19, 2020, with respect to a workplace located at 33128 Sawgrass Park Place, Lot 262, Unit 7A, Flora Parke, Yulee, Florida 32041.
