29 CFR  1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:   a) On August 4, 2023, at the above addressed jobsite, employees conducting roofing work from ladder jack scaffolds, 10 feet three (3) inches and 10 feet six (6) inches above the ground, were not provided with guardrails, midrails, cross rails or other means of fall protection, thereby exposing the employee to falls. No abatement certification or documentation is required for this item.  Ali Josue Correa Ortiz was previously cited for a violation of this occupational safety and health standard 1926.102(a)(1), which was contained in OSHA inspection number 1505117, citation number 1, item number 1, and was affirmed as a final order on February 1, 2021, with respect to a workplace located at 509 Saint James Court in Oak Brook, Illinois.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) On August 4, 2023, at the above addressed jobsite, employees performing framing of a residential home, approximately 12 feet above the ground below, were not secured to a personal fall arrest systems or other means of fall protection, thereby exposing the employees to fall hazards.    b) On August 4, 2023, at the above addressed jobsite, employees performing framing of a residential home, approximately 21 feet above the ground below, were not secured to a personal fall arrest systems or other means of fall protection, thereby exposing the employees to fall hazards.
